Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MetaSnap social media content generation and publishing platform (the "Service") operated by Tyaplyap ("we", "us", or "our") and available at metasnap.tyaplyap.com. By accessing or using MetaSnap, you agree to be bound by these Terms and our Privacy Policy.

1. Description of the Service

MetaSnap is a web application that enables users to:

• Generate social media cards from article URLs using OpenGraph metadata extraction
• Create and customize visual overlays, text, filters, and crops on generated cards
• Generate AI-enhanced captions, descriptions, and hashtags using configured AI providers
• Render MP4 videos with Ken Burns effects and background music from generated cards
• Upload images and audio files for use in content creation
• Publish generated content directly to connected social media platforms (Instagram, TikTok, YouTube)
• Automate content discovery and generation from RSS feeds and article sources via batch processing
• Manage multiple social media account connections

2. Account Registration

To use MetaSnap, you must:

• Create an account with a valid email address and a password meeting our strength requirements (minimum 8 characters, including uppercase, lowercase, and a digit)
• Be at least 16 years of age
• Provide accurate registration information
• Maintain the security of your credentials

You are responsible for all activities under your account. If you suspect unauthorized access, change your password immediately and contact us.

Administrator accounts have additional capabilities including user management and system configuration. The first registered user automatically receives administrator privileges.

3. Acceptable Use

When using MetaSnap, you agree to:

• Comply with all applicable laws and regulations
• Respect the terms of service of all connected social media platforms
• Not use the Service for any illegal, harmful, or fraudulent purpose
• Not attempt to gain unauthorized access to the Service, other accounts, or underlying systems
• Not interfere with or disrupt the Service
• Not upload malicious content, malware, or excessively large files beyond stated limits

4. Prohibited Content

You may not use MetaSnap to create, store, or publish content that:

• Is illegal, threatening, abusive, harassing, defamatory, or obscene
• Infringes upon intellectual property rights of others
• Contains or promotes misinformation, deception, or fraud
• Constitutes spam, phishing, or unsolicited commercial communication
• Violates the privacy of others
• Impersonates any person or entity
• Violates the content policies of connected social media platforms

5. Content Ownership and License

Your Content. You retain all ownership rights to content you create, upload, or submit through MetaSnap. By using the Service, you grant us a limited, non-exclusive, worldwide license to process, store, transform, and transmit your content solely for the purpose of providing the Service. This license terminates when you delete your content or close your account.

Generated Content. Content generated by AI features (captions, descriptions, hashtags) is provided as a tool for your use. You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing. AI-generated content may be inaccurate, incomplete, or unsuitable; we do not guarantee its quality, accuracy, or appropriateness.

Third-Party Content. When you submit URLs for card generation, you represent that your use of content from those URLs is permitted under applicable law (e.g., fair use, license, or public domain). You are responsible for ensuring you have the right to use and publish any content derived from third-party sources.

6. Social Media Platform Integrations

MetaSnap connects to third-party social media platforms via their official APIs:

• Instagram (Meta): via Meta Graph API. Subject to Meta Platform Terms.
• TikTok: via TikTok Content Posting API. Subject to TikTok Developer Terms.
• YouTube: via YouTube Data API. Subject to YouTube Terms of Service and Google API Terms.

By connecting a platform, you authorize MetaSnap to publish content on your behalf using the permissions you grant during the OAuth authorization process. You may disconnect any platform at any time.

We are not responsible for:

• Changes to third-party APIs that affect functionality
• Content moderation actions taken by platforms on your published content
• Data processing performed by platforms after content is published
• Availability or uptime of third-party services

7. AI Services and Limitations

MetaSnap uses AI services to generate captions, descriptions, and hashtags. The default AI provider is PublicAI. You may configure alternative providers using your own API keys.

Important limitations:

• AI-generated content may contain errors, inaccuracies, or biases
• You are solely responsible for reviewing all AI output before publishing
• We do not guarantee that AI-generated content is original, non-infringing, or suitable for any particular purpose
• AI service availability depends on third-party providers and may be interrupted

8. API Keys

You may provide your own API keys for AI providers and other services. You are responsible for:

• Complying with the terms of service of each API provider
• Managing your API usage and associated costs
• Keeping your API keys secure

We encrypt stored API keys at rest but cannot guarantee absolute security. If you believe an API key has been compromised, revoke it immediately with the provider and update it in MetaSnap.

9. Media Uploads and Storage

MetaSnap accepts the following uploads:

• Images: up to 10 MB per file for social card generation
• Audio: up to 15 MB per file (MP3, WAV, M4A, AAC, OGG), maximum 10 files per account, for video background music

Uploaded files are stored on our servers and associated with your account. You may delete uploaded files at any time. Files are permanently deleted when you close your account.

10. Batch Automation

The batch automation feature allows you to configure RSS feeds and article sources for automated content discovery and generation. When enabled:

• The system periodically fetches articles from your configured sources
• Content is generated automatically using your layout and prompt settings
• If auto-publish is enabled, content may be published to your connected platform without manual review of each individual post

You are responsible for the content published through batch automation, including compliance with platform terms and applicable law. You may disable automation and review content before publishing at any time.

11. Service Availability

MetaSnap is provided on an "as available" basis. We do not guarantee uninterrupted, error-free, or secure operation. Service may be interrupted for maintenance, updates, or circumstances beyond our control. Video rendering requires FFmpeg and may not be available in all deployment environments.

12. Account Suspension and Termination

We may suspend or terminate your account if:

• You violate these Terms or our Privacy Policy
• Your use poses a security risk to the Service or other users
• We are required to do so by law
• We discontinue the Service

You may close your account at any time by contacting us or through account settings if available. Upon closure, your data will be handled as described in our Privacy Policy.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated content will be accurate, complete, or suitable
• Content published to third-party platforms will remain available

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or EUR 100, whichever is greater
• We are not responsible for content published to third-party platforms or actions taken by those platforms
• We are not liable for losses resulting from third-party API failures, changes, or unavailability

15. Indemnification

You agree to indemnify and hold harmless MetaSnap, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create, generate, or publish through the Service
• Your use of batch automation features

16. Modifications to Terms

We may modify these Terms at any time. We will update the "Last updated" date and, for material changes, provide notice through the Service. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree with the changes, you should stop using the Service and close your account.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Italian Republic, without regard to its conflict-of-laws provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Italy. Where you are a consumer resident in the European Union, you retain the protections of the mandatory consumer-protection rules of your country of residence.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MetaSnap regarding the Service and supersede any prior agreements.
